Terms of Service

    These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Dominic Mueller, operating as Locapage ("we", "us", "Company"), Mainzer Str. 19, 50678 Köln, Germany. By accessing or using Locapage, you agree to be bound by these Terms. If you do not agree, do not use the service.

    1. Definitions

    • "Service" means the Locapage website builder platform, including website generation, hosting, and all related features.
    • "Content" means all text, images, data, and other materials generated or displayed through the Service.
    • "AI-Generated Content" means any text, copy, or media automatically created by artificial intelligence models on behalf of the Customer.
    • "Customer Website" means the website generated and hosted by Locapage for a Customer's business.

    2. Acceptance of Terms

    By creating a website, subscribing, or otherwise using Locapage, you confirm that you are at least 18 years old and have the legal authority to enter into this agreement. You also agree to our Privacy Policy, Cookie Policy, and Refund Policy.

    3. Service Description

    Locapage provides an automated website generation and hosting service for local businesses. Using publicly available Google Business data, Locapage generates an SEO-optimized website with hosting, SSL certificate, and AI-generated content included. The Service is provided on an "as available" basis and may be modified, updated, or discontinued at any time.

    4. AI-Generated Content — Assumption of Risk

    IMPORTANT — PLEASE READ CAREFULLY: Locapage uses artificial intelligence to generate website content. By using the Service, you expressly acknowledge and accept the following:

    • AI-generated content is provided "as is" without any warranty of accuracy, completeness, legality, or fitness for any purpose whatsoever.
    • You assume full and sole responsibility for reviewing, verifying, editing, and approving all content on your Customer Website before and after publication.
    • Locapage and Dominic Mueller are not responsible for any claims, damages, losses, fines, penalties, lawsuits, or liabilities of any kind arising from AI-generated content, including but not limited to: inaccurate or false business information, misleading descriptions, incorrect pricing, wrong opening hours, fabricated reviews or testimonials, copyright or trademark infringements, or any other errors.
    • You must ensure that all content on your website complies with all applicable laws, regulations, and industry standards in your jurisdiction, including consumer protection, advertising standards, and data protection laws.
    • If any third party (including but not limited to customers, competitors, regulators, or rights holders) brings a claim against you based on content on your Customer Website, you bear full responsibility and agree to hold Locapage and Dominic Mueller harmless.
    • Locapage does not provide legal, medical, financial, or professional advice. Content generated by the Service should not be relied upon as such.

    5. Subscription & Billing

    The Service is offered as a monthly subscription at $12/month. Payments are securely processed by Stripe. By subscribing, you authorize recurring charges until you cancel. You can cancel your subscription at any time. Upon cancellation, your website remains active until the end of your current billing period. For refund requests, please see our Refund Policy. We reserve the right to change pricing with 30 days' prior notice.

    6. Customer Responsibilities

    You agree to:

    • Provide accurate and truthful business information.
    • Only create websites for businesses you own or are authorized to represent.
    • Review all AI-generated content and ensure it is accurate and lawful.
    • Comply with all applicable local, national, and international laws and regulations.
    • Maintain the confidentiality of your account credentials.

    7. Intellectual Property

    Locapage retains all rights to its software, platform, branding, documentation, and proprietary technology. You retain ownership of your business information. AI-generated content is provided under a non-exclusive license for use on your Customer Website during your active subscription. This license terminates upon cancellation.

    8. Acceptable Use

    You must not use the Service for:

    • Any unlawful, fraudulent, or deceptive purpose.
    • Distributing spam, malware, or harmful content.
    • Infringing on any third party's intellectual property rights.
    • Interfering with the security, integrity, or performance of the Service.
    • Scraping, reverse-engineering, or attempting to access restricted systems.
    • Creating websites for businesses you do not own or represent.
    • Any activity that could harm Locapage, its users, or third parties.

    9. Third-Party Data & Services

    The Service uses publicly available data from Google Maps/Places and other third-party sources. Locapage does not guarantee the accuracy, completeness, or timeliness of third-party data. We are not affiliated with Google, Stripe, or any other third-party service provider mentioned herein. Third-party services are subject to their own terms and privacy policies.

    10. Disclaimer of Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, Locapage and Dominic Mueller disclaim all warranties, including but not limited to:

    • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
    • Warranties regarding the accuracy, reliability, or completeness of any content (including AI-generated content, business data, images, or descriptions).
    • Warranties that the Service will be uninterrupted, timely, secure, or error-free.
    • Warranties that the Service will meet your specific requirements, expectations, or produce any particular business results.
    • Warranties that any defects will be corrected or that the Service is free of viruses or harmful components.
    • Warranties regarding the accuracy of any third-party data (including Google Business data).

    No business outcome guarantee: Locapage does not guarantee any increase in customers, revenue, web traffic, search engine rankings, or any other business outcome. The Service is a tool; results depend entirely on your business, market, and circumstances.

    11. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER LOCAPAGE NOR DOMINIC MUELLER (AS INDIVIDUAL OPERATOR) SHALL BE PERSONALLY OR PROFESSIONALLY LIABLE FOR ANY:

    • Direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, however caused.
    • Loss of profits, revenue, sales, data, business, business opportunities, anticipated savings, or goodwill.
    • Business interruption or loss of business information.
    • Damages arising from AI-generated content, including inaccurate, misleading, incomplete, defamatory, or unlawful information.
    • Damages arising from unauthorized access to, alteration of, or loss of your data or transmissions.
    • Damages arising from any third-party conduct, products, services, or content.
    • Damages arising from interruption, suspension, modification, or termination of the Service.
    • Damages arising from bugs, viruses, or other harmful components transmitted through the Service.
    • Any claims brought by your customers, business partners, competitors, regulators, or any other third parties in connection with your use of the Service or your Customer Website.
    • Personal injury, property damage, or any other damages of any nature whatsoever.
    • Damages arising from your reliance on the Service or any content provided through it.

    AGGREGATE LIABILITY CAP: In no event shall the total aggregate liability of Locapage and Dominic Mueller, whether in contract, tort (including negligence), strict liability, or any other legal or equitable theory, exceed the lesser of (a) the total amount you have paid to Locapage in the three (3) months immediately preceding the event giving rise to the claim, or (b) fifty euros (€50). This limitation applies even if Locapage has been advised of the possibility of such damages, and regardless of whether any remedy fails of its essential purpose.

    This limitation of liability is a fundamental element of the agreement between you and Locapage. The Service would not be provided to you at the current price without these limitations.

    12. Indemnification

    You agree to fully indemnify, defend, and hold harmless Locapage and Dominic Mueller personally from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

    • Your use or misuse of the Service.
    • Your violation of these Terms or any applicable law.
    • Content displayed on your Customer Website, including any AI-generated content you failed to review, correct, or remove.
    • Any claim by a third party (including your customers, employees, regulators, or rights holders) arising from your Customer Website or your business activities.
    • Your violation of any third party's intellectual property, privacy, publicity, or other rights.
    • Any misrepresentation made by you or on your behalf.
    • Your failure to comply with applicable consumer protection, advertising, or data protection laws.

    This indemnification obligation shall survive the termination of your account and these Terms.

    13. Use at Your Own Risk

    YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. You acknowledge that:

    • The Service is an automated tool and is not a substitute for professional web design, legal review, or business consulting.
    • You are solely responsible for the operation of your business and all decisions made based on or influenced by the Service.
    • Locapage is a technology platform operated by an individual (Dominic Mueller) and does not have the resources of a large corporation. The pricing reflects this, and the liability limitations are a necessary condition for providing the Service at its current price point.
    • Any reliance you place on the Service, its output, or AI-generated content is strictly at your own risk.

    14. Suspension & Termination

    Locapage reserves the right to suspend or terminate your access immediately and without notice for: material breach of these Terms, non-payment, fraud or security risks, illegal activity, or repeated policy violations. Upon termination, your Customer Website will be taken offline. Locapage and Dominic Mueller are not liable for any damages resulting from suspension or termination.

    15. Force Majeure

    Locapage shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet or infrastructure outages, cyberattacks, third-party service failures, or changes in applicable law.

    16. Governing Law & Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Köln (Cologne), Germany. This applies to the maximum extent permitted by applicable law, including for consumers outside Germany.

    17. Waiver of Class Action

    To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Locapage or Dominic Mueller.

    18. Severability

    If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic and legal intent of the original provision.

    19. Entire Agreement

    These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Locapage and supersede all prior agreements, representations, and understandings. No oral or written statement by any representative of Locapage shall modify these Terms.

    20. Changes to These Terms

    We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after such changes constitutes acceptance. If you do not agree with the modified Terms, your sole remedy is to discontinue use of the Service.
